By booking or purchasing any product, service, class or event via bewitchy.com.au, bewitchy.com, or in-store, you agree to these Terms.

1. OUR SERVICES
We provide: psychic readings [in person, phone, video, email], healings, mentoring, personal shopping, spellwork/ritual services, beauty services [spray tans, facials, massage, waxing, aromatherapy], and body modification services [ear/body piercing, tattoos, tooth gems, teeth whitening] and retail products.

2. BOOKINGS & PAYMENT
2.1 All services must be booked online via our website and are pre-paid to secure your appointment. No walk-ins for services.
2.2 If you book the wrong service, we will cancel it or invoice you the difference. Your appointment is not confirmed until full payment is received.
2.3 Gift vouchers and prepaid packages must be redeemed within 6 months from purchase. We will send a reminder before expiry.

3. REFUNDS, RESCHEDULING & NO-SHOWS - ACL COMPLIANT
3.1 Change of mind: We do not offer refunds for change of mind, late arrival, failure to attend, or failure to follow aftercare instructions.
3.2 If we cancel or cannot provide the service: If we need to cancel or reschedule due to illness, emergency or technical failure on our end, we will offer you a reschedule to a comparable service at no extra cost, or a refund for the unprovided portion.
3.3 Major failure: Nothing in this policy excludes your rights under the Australian Consumer Law. You are entitled to a remedy if our services fail to meet a Consumer Guarantee, including refund or reschedule where there is a major failure.
3.4 Rescheduling requests: We do not offer free reschedules for non-emergency reasons. For genuine personal/family emergency, contact us at least 24 hours before your appointment via support@bewitchy.com.au. Approval is at our discretion.
3.5 Gift voucher recipients: One reschedule allowed only. Second non-attendance forfeits the voucher. The purchaser may be notified.
3.6 Lateness: Sessions must start and end on time. If you are late, your session will end at the original time and the lost time is forfeited.
3.7 Sickness: Do not attend if you have a contagious illness. Contact us to discuss phone/video alternatives where applicable.

4. YOUR RESPONSIBILITIES & CONDUCT
4.1 You must provide accurate health information including allergies, skin conditions, medications, blood-borne conditions and pregnancy before any piercing, tattoo, beauty or healing service.
4.2 Age: You must be 18+ for tattoos and some piercings with valid photo ID. Minors require a parent/guardian present with ID and written consent in accordance with WA law. We reserve the right to refuse service if age cannot be verified.
4.3 You agree not to attend under the influence of drugs or alcohol, and not to engage in abusive, threatening, harassing or unsafe behaviour. We reserve the right to refuse service, end a session, or ask you to leave if your behaviour makes our staff or clients feel unsafe.

5. MUTUAL CONFIDENTIALITY & NO RECORDING - 2 WAY STREET
5.1 No recording by clients: You are not permitted to audio record, video record, photograph, live-stream, or screen-record any part of our services, readings, classes, healings, mentoring or spellwork without our prior written consent. This includes in-person, phone, video and online services.

5.2 Confidentiality obligation on clients: Anything shared, discussed, revealed or performed during a reading, healing, mentoring session, ritual or spellwork is private and confidential. You agree not to publish, post, broadcast, share or disclose the content of your session, or the personal information of our practitioners, to any third party, on social media, or in any public forum.

5.3 Confidentiality obligation on us: We will treat all information you share during services as private and confidential and will not disclose it to third parties, except where required by law, where you have given consent, where we need to seek legal advice, or where there is a risk of harm. We may use anonymised, non-identifiable examples for educational purposes - your name and identity will never be revealed.

5.4 Breach: Breach of clauses 5.1 or 5.2 may result in immediate termination of your service and a request to delete the recording. We reserve the right to seek removal of published material.

6. SERVICE DISCLAIMERS
A. Psychic, Spiritual, Healing, Mentoring & Spellwork - Insight Only
LEGAL & MEDICAL ADVICE IS PSYCHIC INSIGHT & PREDICTION ONLY. We are not medical doctors, nurses, psychologists, lawyers or solicitors. We do not diagnose, prescribe, or provide professional legal advice. Our services are for spiritual insight, guidance and entertainment purposes only. Always seek advice from a qualified medical, legal or financial professional. You are solely responsible for decisions you make following a service. Spellwork and ritual outcomes are not guaranteed.

B. Beauty & Body Modification
All body modification and beauty services carry inherent risks including pain, bleeding, swelling, bruising, infection, allergic reaction, scarring, and variable results. You accept these risks. Aftercare is your responsibility. We provide written aftercare - failure to follow it may affect healing.

7. NO GUARANTEES
We do not guarantee specific outcomes, accuracy, or results from any reading, healing, spellwork or beauty service. Results vary per person.

8. WARRANTIES, LIABILITY & AUSTRALIAN CONSUMER LAW
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Competition and Consumer Act 2010 or similar state laws that cannot be excluded. To the maximum extent permitted by law and subject to this clause, our liability for failure to comply with a Consumer Guarantee is limited to re-supplying the service or refunding the amount paid for the unprovided portion.

9. INTELLECTUAL PROPERTY
All content, trademarks including BeWitchy®, course materials, and designs remain our property.

10. GOVERNING LAW
These Terms are governed by the laws of Western Australia, Australia.
